There is no shortage of compliance fatigue as associations and their members struggle to prepare for the myriad of legal requirements from well-intentioned legislators. Complying with information protection laws, such as the Red Flags Rule, traditionally has been a checklist approach of line items to ensure that policies meet the letter of the law. However, when information has been lost, associations and their members have an incredible amount of unnecessary liability even though they feel protected by these policies. This participant directed discussion focuses on common pitfalls that make information exposure compliance impossible for any organization. Recognize “unknown” aspects of institutional and personal liability retained in your current compliance programs. Evaluate the benefits of proven practice methodology to build a defensible position for information exposure, regulators, lawsuits, insurance claims, vicarious liability and consumer confidence.
